Clavis Management is able to provide key official services to gaming operations set up under the LGA’s guidance. A Key Official would need to be appointed within 21 days from issue of the Letter of Intent.

The Key Official acts as the primary point of contact with the Lotteries and Gaming Authority. He has to be a resident in Malta, since he is required physically in order to assist the hosted servers of the gaming system. Indeed, the Key Official cannot be out of the country for long duration, since the LGA might request any information from the key official, so this person has to be available at any time.

The Key Official must be the director of the licensee company. He upholds the values and integrity of the license, and gives truly independent and unbiased advice. By carrying out monitoring processes, this person is bound to ensure that the licensee is performing to certain accepted standards and verify that the licensee is adhering to remote gaming regulations.

The Key Official is also the responsible body for informing and updating the LGA with regards to any changes made to the hardware and software of the licensee. He manages certification and reporting/ monitoring processes. Periodic reports need to be presented (monthly reports, signing and presenting of interim and annual accounts, responding to queries and requests from the LGA.) In addition, exception reports need to be presented within the prescribed time limits (incident reports to be delivered within 24 hours, EU and NSO requests, notifying the Data Commissioner on Personal Data Transfers).  The Key Official assists the certification process and obtains necessary approvals from the LGA on a case-by-case basis as the need arises. He also makes sure that monthly gaming tax and annual gaming license fee are paid to the LGA and asserts that client money and personal data are safe and secure.

Apart from being in contact with the LGA, the Key Official is also linked with other entities. He provides statistical information to the National Statistics Office (NSO) and EuroStat. The Key Official liaises with the Employment and Training Corporation (ETC) regarding Human Resources and Employment Information. He also works closely with the Financial Intelligence Analysis Unit (FIAU) in case of suspicious transactions. Similarly, he collaborates with personnel from the ISP or co-location provider to identify and report any faults affecting the licensee operations. He keeps up-to-date with the ISP backup and operational procedures and ensures that the ISP fulfils the contractual obligations properly.
